原标题：三亚5部门整治汽车租赁行业&违规代驾或罚10万
摘要：12月19日，三亚市5部门联合整治汽车租赁行业，对全市范围内的汽车租赁行业进行整治，打击道路运输非法营运行为，违规代驾或罚10万元。从11月24日至今，共查扣非法营运汽车19辆，查处公交违规行为25起，出租车违规行为41起，查处其他各类违规行为57起。
网易河北讯& 近期，在对全市范围内77家提供汽车租赁服务的公司进行暗访、摸底后，12月19日，三亚市交通运输局运管处联合公安、工商、旅游质监、综合执法等部门展开联合执法，对全市范围内的汽车租赁行业进行整治，打击道路运输非法营运行为。当天执法人员现场整顿违规行为10余起，包括涉嫌无证照经营、擅自设立分支机构、擅自配备司机代驾、经营场地与营业执照备案地址不符等违规行为。
当天，联合执法人员先后前往老铁路、金鸡岭街、吉祥街等多条路段进行突击检查。记者看到，这些路段人流、车流密集，汽车租赁点也较为集中，短短百米范围内，除了汽车租赁公司和很多挂牌提供汽车租赁服务的旅行社，还有租用其它办公场所进行汽车租赁宣传或办公的租赁点。执法人员对这些汽车租赁点的营业执照、经营范围等进行详细检查。
在老铁路上，有两家汽车租赁公司打出了接送机价格的广告牌，“普通小车5座，市区接送机100元，包车自由行300元/天。配备司机按一天8小时计算收取100元服务费。”执法人员当场对广告牌进行拆除。
“汽车租赁不能提供代驾租车服务，一旦查实，将按照有关规定处以3万至10万元不等的罚款。”据执法人员介绍，代驾租车业务是指在汽车租赁过程中，同时提供驾驶员的有偿服务。据了解，代驾租车实质上是一种客运经营，本质上属于出租汽车业，不属于汽车租赁业范畴，而代驾租车是目前存在于国内汽车租赁企业中常见的一种违法经营方式。
在金鸡岭街，一汽车租赁点无法现场提供营业执照，其工作人员表示该点为原租车公司的分支机构，执法人员责令其立即清理办公场地，进行停业整顿；在吉祥街，执法人员也对多家提供汽车租赁服务的旅行社进行了整顿，并将有车辆租赁业务的宣传内容全部撤除。
市交通局运管处执法人员提醒，违规经营的租赁点可能手续不全，服务质量也无法保障，如消费者在租车过程中出现问题时，权益难以维护，希望游客或市民在租车时选择正规租车公司。
据悉，为迎接旅游旺季和春节黄金周，近一个月来，市交通运输局深入各重点区域开展整治工作，从11月24日至今，共查扣非法营运汽车19辆，查处公交违规行为25起，出租车违规行为41起，查处其他各类违规行为57起。

2月20日，来自重庆市运管局消息，《重庆市汽车租赁管理办法》（下称：管理办法）将于3月1日起施行。管理办法不仅规定了汽车租赁行业的准入门槛，还提出汽车租赁经营者禁止的业务，其中之一就是不得向承租人提供代驾服务。小型客车租赁有准入门槛：最少拥有20辆市运管局介绍，从事9座以下（含9座）小型客车租赁经营必须具备六个条件，包括取得工商营业执照；有20辆以上符合国家标准并经检测合格的自有小型客车；租赁车辆保险手续齐备；有与其经营业务相适应的办公场所、停车场地；有相应的业务、管理人员；有健全的安全生产管理制度和服务质量保障措施。经营者需到所在地区县（自治县）道路运输管理机构提交：重庆市小型客车租赁经营申请表；营业执照副本、组织机构代码证；法定代表人或者负责人身份证明；经营场所和停车场地产权证明或者合法租用1年以上的证明；经营组织机构、企业管理制度、业务操作规程、安全管理制度；以及自有车辆行驶证或者购置承诺书。出租车辆不得提供代驾 不得沿途揽客管理办法指出，汽车租赁经营者不得向承租人提供驾驶劳务；不得沿途揽租；不得明知承租人利用租赁车辆从事道路运输经营活动，仍向承租人提供租赁车辆；禁止利用租赁车辆从事道路运输经营活动；不得从事法律、法规禁止的其他行为。租赁汽车要签订书面合同 承租人不得开“黑车”管理办法规定，汽车租赁经营者应当与承租人约定签订书面租赁合同。合同内容应当包括车辆用途、租赁期限、租赁费用及付费方式、车辆交接、担保方式、车辆维护和维修责任、车辆保险、风险承担、违约责任和争议解决方式等条款。签订租赁合同时，汽车租赁经营者应当核对并如实登记承租人的资料包括：个人承租的，必须如实登记个人身份证明和拟驾车人员的机动车驾驶证；法人或者其他组织承租的，必须如实登记营业执照或者组织机构代码证、拟驾车人员的机动车驾驶证、经办人员的身份证明、所在单位的工作证明以及授权经办书。承租人需提供的相关信息合法、真实、有效；不得将租赁车辆交由无相应驾驶资格的人员驾驶；不得将承租车辆进行抵押、变卖或者转租；不得使用承租车辆从事道路运输经营；不得利用承租车辆进行其他违法犯罪活动。
